These Terms of Use ("Terms") govern your access to and use of the Pro QR Code Generator website, services, and applications (collectively, the "Service"). The Service is provided by Pro QR Code Generator ("we," "us," or "our").

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with these security obligations.

Pro QR Code Generator provides an online platform for creating, customizing, and managing QR codes. Our services include but are not limited to:

• QR code generation for various content types (URLs, contact information, WiFi credentials, etc.)
• Customization options for QR code design and appearance
• Analytics and tracking features for QR code scans

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). • Your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights

• Your User Content does not contain any malicious code, viruses, or harmful components

We do not pre-screen User Content, but we reserve the right to remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited activities include but are not limited to:

• Creating QR codes that link to illegal, harmful, or offensive content, including:
  • Content that violates any applicable law or regulation
  • Malware, viruses, or other harmful software
  • Phishing websites or fraudulent content
  • Adult content or material inappropriate for minors
  • Hate speech, harassment, or discriminatory content
• Using the Service to send unsolicited commercial messages (spam)
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
• Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure
• Using any robot, spider, crawler, scraper, or other automated means to access the Service for any purpose
• Bypassing the measures we may use to prevent or restrict access to the Service
• Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity

The Service and its original content, features, and functionality are and will remain the exclusive property of Pro QR Code Generator and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You acknowledge that the QR codes you generate using our Service may incorporate our proprietary technology and design elements.

You retain ownership of the content you encode in your QR codes, but the QR code generation technology, design templates, and platform features remain our intellectual property.

Certain features of the Service require payment. By selecting a paid plan, you agree to pay the specified fees. All payments are processed through secure third-party payment processors.

No Refund Policy: All sales are final. We do not provide refunds for any paid plans, including Monthly, 6-Month, Annual, or Lifetime plans. Please review our Replacement Policy for information about service replacements.

Subscription Renewal: For recurring subscriptions, your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You are responsible for canceling your subscription if you no longer wish to use the paid features.

Price Changes: We reserve the right to change our pricing at any time. Price changes will not affect existing subscriptions until the next renewal period.

Taxes: All fees are exclusive of taxes, which will be added to your invoice where required by law.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT:

• THE SERVICE WILL MEET YOUR REQUIREMENTS
• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS
• ANY ERRORS IN THE SERVICE WILL BE CORRECTED

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRO QR CODE GENERATOR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• ANY CONTENT OBTAINED FROM THE SERVICE
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX MONTHS, OR IF YOU HAVE NOT PAID ANYTHING, ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold harmless Pro QR Code Generator and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party
• Your violation of any applicable law, rule, or regulation

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration in Santa Clara County, California, in accordance with the rules of the American Arbitration Association. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

It is your responsibility to review these Terms periodically for changes. The "Last Updated" date at the beginning of these Terms indicates when the latest revisions were made.
